Niger: House of Assembly dares court, orders LG chairmen’s sack



Barely two weeks after a New Bussa High Court ruled against reduction of Local Government Council Chairmen’s tenure, the Niger State House of Assembly has directed Governor, Abubakar Sani-Bello to immediately dissolve the 25 Local Government Councils including the Chairmen for failure to discharge their duties and functions.

The decision was taken at plenary yesterday after the presentation of an oversight of all the 25 local government councils in the state. It was learnt that the Presiding Judge, Justice Mohammed Mohammed had last two weeks ruled that the state House of Assembly in particular lacked requisite power to amend the Local Government (Amendment) Law 2016 of Niger State, published as Niger Legal Notice No 1 which Governor Sani Bello appended his signature to make it to become law.

The House, which received a report of the House Committee on Local Government, chaired by Hon. Abdulmalik Muhammad Kabir, representing Paikoro Constituency in its resolution and a motion directed the governor to conduct a fresh election within three months.

The motion, seconded by Hon. John Paul Bahago, representing Munya Constituency, also directed the sacked chairmen to handover the affairs of the councils to their respective Director of Personnel Management (DPM), even as the Assembly accused the chairmen of failure to discharge their duties and functions under the Niger State Law, 2001.”

They further said that the legislative councils failed to hold meetings and sittings as required under Section 38; subsection (1) of Niger State Local Government Law, 2001. Furthermore, it was discovered that none of the Councils’ legislative arm sat for at least 50 times as against the minimum 90 times per session.
